You make the pattern, then when you go to submit it there is a little checkbox at the bottom of the page above the submit to site button. You check that to accept the terms and conditions

When you open the create page in your web browser you will see the notice that you haven’t accepted the terms. You should be able to make your pattern still but not be able to submit it. When it comes time you want to submit it there’s a tick box under the keywords section that accepts the terms.
